Why Registration Matters

Copyright exists the moment your work is created, but registration with the U.S. Copyright Office is what gives you the full power to enforce it.

For U.S. works, registration is generally required before you can file an infringement lawsuit. Timely registration can also make statutory damages and attorney's fees available, and creates a public record of your ownership.

Questions

Common copyright questions.

Do I need to register to own a copyright?

No. Copyright protection exists as soon as an original work is fixed in a tangible form. Registration, however, is generally required before suing for infringement of a U.S. work, and timely registration can make statutory damages and attorney's fees available.

What's the difference between copyright and trademark?

Copyright protects original creative expression, such as text, images, software, music, and video. Trademark protects the names, logos, and slogans that identify your goods or services. Many businesses need both, and we can handle them together.

I'm based outside the United States. Can you help?

Yes. We represent foreign creators and businesses in registering and enforcing their copyrights under U.S. law. We do not advise on foreign law.

Someone copied my work online. What can I do?

Options often include a DMCA takedown notice to the platform or host, a cease-and-desist letter, and, where appropriate, an infringement lawsuit. We'll review your situation and recommend the right approach.

Who will handle my matter?

Kyle Scudiere, Esq. personally handles or oversees all Solace Law clients.
